Detailed information

The arrangement of examination of child cases facing the law in the Children's Court in Law No. 3 of 1997 concerning The Children's Court with Law No. 11 of 2012 on the Child Criminal Justice System, namely the Children's Court Law, determines that in handling cases children face to face with the law in the Court only apply the rules of formal examination, namely through the proceedings. The provisions of the examination of the case of Children Facing the Law are specifically stipulated in Chapter IV Paragraph 4 Of Article 55 to Article 59. While in the Law of the Criminal Justice System of Children is stipulated that before passing the proceedings the judge must seek the settlement of the child's case in diversion or also called the settlement of the child's case outside the court (informal). As stated in Article 52 Paragraph (2). Furthermore, the case of Children Facing the Law will proceed to the court stage if a diversionary settlement is not successfully implemented (Article 52 Paragraph (6) of the Law of the Criminal Justice System of Children).
