The OHADA law seems to be among the first to create a community law on debt collection and enforcement in French-speaking Africa.In the same way, when it comes to politics, there are regional and sub-regional organizations, and in the same way, OHADA law brings together certain countries to harmonize the law and its various procedures.The OHADA system was born of an active and ambitious political will to strengthen the legal system of states in the business world, by simplifying the legal framework and harmonizing trade in Africa.The relationship between creditor and debtor presupposes the existence of an obligation, in the legal sense of the term, i.e. a legal relationship by virtue of which the former requires the latter to give, do or refrain from doing something. This legal relationship may arise from a legal act (law, contract) or a legal fact (tort, quasi tort, quasi contract).So it seemed appropriate to talk about the impact of the PSRVE on common law procedure in the DRC.
