Detailed information

The main purpose of this work is to analyse the institute of Curatorship in the face of the interdiction process, looking at the teachings and innovations brought about by the Statute for People with Disabilities, which is governed by Law 13.146/2015. it is important to highlight Curatorship as a means to be used to guarantee protection for disabled people over the age of 18, as well as to safeguard the interests of incapacitated people over the age of eighteen in general. It so happens that in the light of the new legal statute, the Statute of the Person with a Disability, there has been a certain evolution with regard to the autonomy of individuals who need special care to manage the acts of their civil life. In this way, we analysed the extent to which it would be possible to guarantee effective autonomy to those who, before the changes brought in by Law 13.146/2015, were considered absolutely or even relatively incapable.
