Detailed information

The book aims to conceptualise the current problem in family society called Parental Alienation, highlighting the possibility of imputing moral damage in this specific field of Family Law. It is known that Parental Alienation emerged in the mid-1980s with the studies of psychiatrist Richard Gardner. In Brazil, it was defined by law 12.318/2010, which conceptualises it as the damage caused to the establishment or maintenance of the family bond between a child or adolescent and one of their parents by those who exercise some kind of authority or surveillance over them. It is true that this problem plagues many families, mainly due to the large increase in the number of divorces in recent years, especially with the enactment of Law 11.618/2008 and Constitutional Amendment 66/2010. Thus, this work aims to highlight the forms described in Law 12.318/2010 as conduct that generates the practice of Alienation and to analyse them from the perspective of civil liability.
