Biopatents are patents pertaining to life forms excluding microorganisms. This field of patent is in a very nascent stage whereby a stiff conflict goes on between developed and developing countries. Biopatents are a means to develop disease resistant varieties of plants, animals and genetic improvement of human beings whereby strong progenies may be born in future. The TRIPS agreement has provided for a balancing approach whereby the developing countries are given freedom to incorporate the terms of the agreement in their laws within definite time frame.
